What The Laws of CBD and THC Means To Florida Residents and How To Keep Users Safe
The Florida legislature created the State Hemp Program under Florida statute 581.217. Florida’s Department of Agriculture and Consumer Services enforces and regulates the state’s hemp program
his program is federally legal due to the 2018 Farm Bill. While hemp is generally noncontroversial, its more controversial chemical cousins,
Delta-7 THC, Delta-8 THC (D8), and Delta-10 THC have caused a lot of contention throughout the country. D8 is one of many naturally occurring cannabinoids in the cannabis plant; however, the federally illegal form of THC is Delta-9 THC (D9).
In a July 2021 advisory opinion, Florida Department of Agriculture neither supported nor condemned D8; rather, it explained that D8 is naturally occurring in the cannabis plant and state regulatory testing and compliance is being enforced. The opinion also stated, “Until comprehensive, nationwide standards are adopted, consumers have no way of knowing what post-processing steps were taken to ensure the safety of these products.” Although safety is a concern with recreational D8 users in today’s society, D8 has long had its place in medicine. Like cannabis, D8 cannabinoid has been known to reduce pain in patients as cited on pubmed.ncbi.nlm.nih. gov/29450258/; however, used unwisely, like all substances, D8 may harm the user.
Beyond agriculture and consumer goods, cannabis has also found a foothold in related industries such as healthcare and pharmaceuticals.
Collectively, this means that residents of Florida can enjoy different forms of THC like D8, D7, and D10 without being concerned about its legality. However, “user beware,” if law enforcement suspects that your edibles or smokables contain more than 0.3 Delta-9 THC. You may be prosecuted.
As one of the fastest-growing industries in the nation, discussions will include key trends, up-and-upcoming developments, and untapped investment mediums. For the most part, in consideration of positioning for a post-legalization return on investment. The upcoming Cannabis Investors Summit will offer cutting-edge information, policy updates, and pending legalizations, specifically in Florida, to ensure that attendees have a comprehensive market understanding. Future summits are planned for additional locations in 2022.
The legalization of cannabis and its separate cannabinoids is one of our nation’s most controversial subjects and intersects some of our nation’s most polarizing topics; however, if regulated properly, legal adult use and medicinal use of cannabis will grow our economy and reinforce safety. Our nation needs this economic surge coming out of COVID-19. We are witnessing each state exercise its authority as a laboratory of democracy to most effectively and efficiently navigate the social, political, criminal, and economic consequences of this topic. If we want more equitable treatment in business and safer communities, we
must pass federal comprehensive legislation.
